Terms and Conditions

These terms apply when you use Test Engine AI to create, host or take online tests. By using the service, you agree to them. If you use it on behalf of an organization, you confirm that you have the authority to accept them for that organization.

Your account

You must give accurate information and keep your login details secure. You are responsible for activity on your account. If you are under the age required to enter into this agreement where you live, you may use the service only with the involvement of a parent, guardian or your institute.

Organizations

Institutes and teachers using the service are responsible for:

  • the tests they publish and the students, groups and members they add;
  • having a lawful basis and any consent needed to use student data, including for minors and for sending results to parents or advisors;
  • telling students about any integrity controls in use, including webcam or audio monitoring;
  • decisions they make about students based on results or integrity flags.

Acceptable use

You agree not to:

  • cheat, impersonate another test-taker, or bypass integrity controls;
  • copy, leak or share private test content without permission;
  • upload content that is unlawful or that infringes the rights of others;
  • interfere with the service, access it without authorization, or scrape it;
  • use the service to send spam or harass anyone.

Your content

You keep ownership of the content you upload. You give us a non-exclusive, worldwide licence to host, store, copy, display and process it as needed to run the service, including to generate AI analysis. You confirm that you have the rights needed to grant this licence.

Public tests, copies and sales

If you mark a test as public, other organizations can copy it. A copy is an independent version that its new owner can change, marked as a duplicate with a reference to the original. Later changes to your test will not update existing copies, and making a test private does not remove copies already made. Where tests are sold between organizations, the seller is responsible for having the rights to what it sells.

AI analysis and predictions

Diagnostics, explanations and predicted scores or percentiles are automated estimates. They can be wrong and are not a guarantee of any exam result. Integrity flags are signals for human review and do not prove misconduct.

Fees

Some features may be paid. Any prices and billing terms will be shown before you buy. Refunds are covered by our Refund Policy.

Availability and changes

We work to keep the service reliable, but we do not promise it will be uninterrupted or error-free, including during a live test. We may change or discontinue features.

Suspension and ending your use

You can stop using the service at any time. We may suspend or close accounts that break these terms or put the service or other users at risk.

Disclaimers and liability

To the extent the law allows, the service is provided "as is" without warranties of any kind, and we are not liable for indirect or consequential losses, or for loss of data, profits or academic opportunities. Nothing in these terms limits any liability or consumer rights that cannot legally be limited.

Governing law

These terms are governed by the laws of the jurisdiction in which the operator of Test Engine AI is established, without limiting any mandatory rights you have where you live.

Changes to these terms

We may update these terms. If you keep using the service after changes take effect, you accept the updated terms.
